TERMS OF SERVICE

OVERVIEW

Welcome to OneTennis.

These Terms of Service govern your use of the One Tennis website and online store, including the information, content, features, tools, products and services made available through the website (the “Services”).

The Services are operated by One Tennis Ltd (“One Tennis”, “we”, “us” or “our”). Our online store is powered by Shopify, which enables us to provide the Services to you.

By accessing, browsing or using our Services, or purchasing products from us, you agree to be bound by these Terms of Service and any policies referred to in them, including our Privacy Policy and Returns and Refunds Policy.

Please read these Terms of Service carefully. If you do not agree to these Terms, you should not use or access our Services.

Nothing in these Terms affects your statutory rights as a consumer.

SECTION 1 – ACCESS AND ACCOUNT

By using our Services, you confirm that you are legally able to enter into a contract.

If you are under 18, you should only use our Services with the involvement and consent of a parent or guardian.

When using our Services or placing an order, you may be asked to provide information such as your name, email address, billing information, payment information and delivery address.

You agree that the information you provide is accurate, current and complete and that you have the right to provide it.

If you create an account with us, you are responsible for maintaining the security of your account details and for all activity carried out through your account.

You must not transfer, sell, assign or otherwise allow another person to use your account.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, images and other information on our website are accurate.

Colours and the appearance of products may vary slightly depending on your device, screen settings and other technical factors.

Product descriptions, specifications, availability and prices may be updated from time to time.

We reserve the right to discontinue products and to limit quantities available for purchase.

Nothing in these Terms affects your statutory rights. Products supplied by us must be as described, of satisfactory quality and fit for their intended purpose as required by applicable consumer law.

SECTION 3 – ORDERS

When you place an order through our website, you are making an offer to purchase the products in your order.

We reserve the right to decline or cancel an order in circumstances including where a product is unavailable, there is an obvious pricing or product description error, or we reasonably suspect fraudulent or unauthorised activity.

Your order will be accepted when we confirm acceptance of your order, normally by email.

We must receive and process your payment before your order is accepted.

Please check your order carefully before completing your purchase. If you need to make a change or cancel an order, please contact us as soon as possible. We will try to accommodate requests where possible, but we may be unable to change or cancel an order once it has been processed or dispatched.

If we are unable to accept, change or cancel an order, we will contact you using the email address, billing address or telephone number provided with the order.

Your purchases are subject to our Returns and Refunds Policy.

Nothing in our Returns and Refunds Policy or these Terms limits or excludes your statutory rights as a consumer.

Unless otherwise agreed with us, products purchased through our store are intended for personal or household use and not for commercial resale.

SECTION 4 – PRICES AND BILLING

All prices shown on our website are in pounds sterling (£).

Prices shown include VAT where applicable. If VAT is not applicable to a particular purchase, no VAT will be charged.

Delivery charges are displayed separately before you complete your purchase.

Prices, discounts and promotions may change from time to time. The price charged for a product will normally be the price displayed at the time your order is placed and will be confirmed in your order confirmation.

We may offer promotional discounts from time to time. Promotional offers may have additional terms and conditions, which will be made clear at the time of the promotion.

If there is a conflict between the terms of a specific promotion and these Terms of Service, the terms of the promotion will apply to that promotion.

You agree to provide accurate and up-to-date payment and contact information when placing an order.

You confirm that you are authorised to use the payment method provided for your purchase.

SECTION 5 – SHIPPING AND DELIVERY

We aim to dispatch orders within the timeframe stated on our website.

Delivery times are estimates and may occasionally be affected by circumstances outside our control, including delays with delivery providers or other events beyond our reasonable control.

Where available, we will provide tracking information for your order.

If your order is delayed, lost or arrives damaged, please contact us at jake@onetennis.co.uk and we will work with you to resolve the issue.

We will deliver your order within the timeframe agreed with you and, unless otherwise agreed, within 30 days of the order being placed.

Nothing in these Terms affects your statutory rights relating to delivery.

SECTION 6 – INTELLECTUAL PROPERTY

Our Services and their contents, including our trademarks, logos, text, images, graphics, photographs, videos, product descriptions, designs and other materials, are owned by or licensed to One Tennis Ltd and are protected by applicable UK and international intellectual property laws.

You may use our Services for your personal, non-commercial use.

You must not reproduce, copy, modify, distribute, publish, sell, licence or otherwise exploit material from our Services without our prior written permission, except where permitted by law.

Nothing in these Terms grants you any licence or other rights to use our intellectual property except as expressly stated.

The One Tennis name, logo, product names, designs and slogans are trademarks of One Tennis Ltd or its licensors. You must not use our trademarks without our prior written permission.

Shopify’s name, logo and other trademarks belong to Shopify. All other trademarks appearing on our Services belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools or services as part of our Services.

We do not necessarily monitor or control these third-party tools and are not responsible for their operation.

Any use of third-party tools is subject to the terms and conditions of the relevant third-party provider.

We may introduce new features, tools or services in the future. Any such features will form part of the Services and will be subject to these Terms unless otherwise stated.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to websites or services operated by third parties.

We are not responsible for the content, availability, accuracy or practices of third-party websites.

If you choose to access a third-party website, you do so at your own risk and should review that website’s terms and policies.

Any purchases or transactions you make with a third party are between you and that third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

One Tennis is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make through our store are made directly with One Tennis Ltd.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and One Tennis, including any injury, damage or loss resulting from products purchased from us.

You hereby expressly release Shopify and its affiliates from claims, damages and liabilities arising from or related to your purchases and transactions with One Tennis, to the extent permitted by law.

SECTION 10 – PRIVACY POLICY

Any personal information we collect through the Services is handled in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use and protect your personal information and can be accessed through our website.

Because our store is hosted by Shopify, Shopify may also collect and process information about your use of the Services in accordance with Shopify’s own privacy policies.

By using our Services, you acknowledge that you have read and understood our Privacy Policy.

SECTION 11 – FEEDBACK

If you submit reviews, feedback, suggestions, ideas or other content to us, you give us permission to use, reproduce, modify, publish and display that content for purposes connected with operating, improving and promoting One Tennis.

You confirm that you have the necessary rights to any content you submit and that your submission does not infringe the rights of another person.

You must not submit content that is unlawful, misleading, defamatory, abusive, obscene or otherwise inappropriate.

We reserve the right to remove content that we reasonably consider to breach these Terms or applicable law.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to products, pricing, promotions, delivery charges, availability or other information.

We reserve the right to correct errors and update information where necessary.

If an obvious error affects an order you have placed, we will contact you where reasonably possible and give you the option to proceed with the corrected information or cancel the order where appropriate.

Nothing in this section limits your statutory rights.

SECTION 13 – PROHIBITED USES

You may use our Services only for lawful purposes.

You must not use our Services:

  • For any unlawful or fraudulent purpose;
  • To violate any applicable UK law or regulation;
  • To infringe our intellectual property rights or the rights of another person;
  • To harass, abuse, threaten or harm another person;
  • To provide false or misleading information;
  • To transmit viruses, malware or other harmful code;
  • To interfere with the operation or security of our Services;
  • To impersonate another person or business;
  • To collect or misuse another person’s personal information;
  • To send spam or other unauthorised promotional material;
  • To reproduce, copy, resell or exploit our Services without our permission; or
  • To attempt to bypass or interfere with security measures used by our website.

We reserve the right to suspend or terminate access to our Services where we reasonably believe that these Terms have been breached.

SECTION 14 – AGENTS

This section applies where software or automated systems access, use or interact with our Services on behalf of a person or organisation.

Any such automated system must identify itself appropriately and must not attempt to conceal its automated nature, bypass security measures or circumvent restrictions placed on access to our Services.

We may restrict or block automated access to our Services where we consider it necessary to protect our website, customers or business.

SECTION 15 – TERMINATION

We may suspend or terminate your access to our Services where we reasonably believe that you have breached these Terms or where necessary to protect our Services, customers or business.

Termination will not affect any rights or obligations that arose before termination.

Any provisions which by their nature should continue after termination will remain in effect.

SECTION 16 – DISCLAIMER OF WARRANTIES

We make reasonable efforts to ensure that the information provided through our Services is accurate and up to date.

However, we do not guarantee that our website or all information made available through it will always be complete, accurate, uninterrupted or error-free.

Our products are supplied in accordance with applicable UK consumer law.

Nothing in these Terms excludes or limits any warranty, condition, right or remedy that cannot legally be excluded or limited under UK law.

SECTION 17 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so.

This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory rights in relation to products supplied by us.

Subject to the above, we will not be liable for losses that were not reasonably foreseeable at the time the contract was formed or for losses arising from circumstances outside our reasonable control.

Nothing in these Terms affects your statutory rights as a consumer.

SECTION 18 – INDEMNIFICATION

Where permitted by law, you agree to compensate One Tennis Ltd for reasonable losses or costs arising directly from your unlawful use of our Services or your deliberate breach of these Terms.

Nothing in this section limits or excludes any rights you have as a consumer or any liability that cannot legally be limited or excluded.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue to apply.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

These Terms, together with our other applicable policies, form the agreement between you and One Tennis Ltd in relation to your use of our Services and supersede previous versions of these Terms.

Nothing in these Terms limits any rights you have under applicable consumer law.

SECTION 21 – ASSIGNMENT

You may not transfer your rights or obligations under these Terms to another person without our prior written consent.

We may transfer our rights and obligations under these Terms where reasonably necessary in connection with our business, provided that this does not reduce your legal rights as a consumer.

SECTION 22 – GOVERNING LAW

These Terms of Service are governed by the laws of England and Wales.

Any disputes arising in connection with these Terms or your use of the Services will be subject to the jurisdiction of the courts of England and Wales, except where applicable law provides otherwise.

Nothing in these Terms affects your statutory rights as a consumer.

SECTION 23 – HEADINGS

The headings used in these Terms are included for convenience only and do not affect the meaning or interpretation of the Terms.

SECTION 24 – CHANGES TO THESE TERMS

You can review the most current version of our Terms of Service at any time on this page.

We may update these Terms from time to time to reflect changes to our business, Services or legal requirements.

Any material changes will be communicated where required by law.

Your continued use of our Services after updated Terms have been published does not affect any rights you have under applicable consumer law.
